Bylaws and standing rules changes

Consolidate banning process

Proposal:
Change Bylaws section 10 Termination of Membership bullet 3 from
After providing the member with reasonable written notice and an opportunity to be heard either orally or in writing, upon a determination by the board of directors that the member has engaged in conduct materially and seriously prejudicial to the interests or purposes of the corporation. Any person expelled from the corporation shall receive a refund of dues already paid for the current dues period.

to

The board can ban a member, the process is defined in the Standing Rules

Change the standing rules (after board approval of the above bylaws change) banning section bullet 2 from

* A person’s ban must be voted on and passed unanimously by the Board of Directors.

to

* Before a person can be banned they must be given reasonable notice and opportunity to discuss their case with the board.
  • A ban must be voted on and passed unanimously by the Board of Directors.

Context
Right now we document the suspension process in the standing rules, and the banning process in the standing rules and the bylaws. I didn't realize till today that banning was split.

So I want to move all of the banning requirements to one place.

The change to the standing rules will not happen unless the board also approves the bylaws change.

Rename suspension to probation

Proposal:
Change the standing rules to replace "suspension" with "probation"

1. Replace every instance of "suspension" with "probation"

  • Section 2: For "A person whose membership is in suspension" replace it with "A person who is under probation"
  • Section 5: "When suspending a membership" with "When placing a member under probation"
  • Directly replace all other instances

2. Change Standing rule suspension first line from

"Suspension" refers to suspension of a person's membership.

to

Probation (historically "Suspension") is when a member temporarily loses all member privileges. A member on probation may still be a guest, as long as the sponsoring member is aware their guest is on probation and why they are on probation.

Context
So right now as disciplinary measures we have suspension and ban. Banning means you are not allowed in the space under any circumstances. Suspension means that you can be in the space as a guest of someone who fully understands that you are suspended and why.

People are sometimes surprised by the guest bit, so I think that "probation" is term that will lead to less confusion.

  • Probation (noun): the release of an offender from detention, subject to a period of good behaviour under supervision.
  • Suspension (noun): the temporary prevention of something from continuing or being in force or effect.
I think suspension (incorrectly) implies that you aren't allowed in the space, while probation means that it's fine with supervision.

Matt is against this proposal because he thinks the term muddies the waters about the status of someone's membership during their suspension. This turned into a discussion of the what accesses people have while they are suspended.

There was also a suggestion of the term "restricted" but that wasn't popular.

Then there was a discussion how "probation" and "suspension" are both confusing terms, but the question is how each is confusing and which confusion is more acceptable. We also discussed whether someone who is suspended is a member without privileges or is not a member during the suspension period.

Potential new language: "Probation (historically "Suspension") is when a member temporarily loses all member privileges. A person on probation may still be a guest, as long as the sponsoring member is aware their guest is on probation and why they are on probation."

This proposal was moved to table by Nate with a second by Matt.
